Professional Experience
Nathan has experience in both commercial and domestic building dispute resolution and has acted for owners, builders, contractors and sub-contractors. His detailed analysis of standard form and bespoke construction contracts has been of great benefit to the firm’s commercial clients, particularly when dealing with difficult variation claims or extension of time claims. He has a detailed knowledge of the mechanisms available in construction disputes and is familiar with workers liens, having used them to aid the successful recovery of monies due to his clients. He has also secured court orders striking out liens improperly registered against his clients’ land.
Nathan has settled numerous disputes in terms favourable to his client well in advance of trail and in some cases before proceedings have even been issued. He has found that clients appreciate a frank assessment of their prospects with a view to resolving their dispute before they become entrenched in litigation. Where appropriate he encourages his clients to consider alternative dispute resolution methods, such as expert determination and mediation. Nathan appreciates that in most cases the last thing his client swant is to be embroiled in a dispute and that they would invariably be more profitably occupied in running their business or enjoying their new building or home. His goal is to allow his client’s energies to return to their preferred endeavours as soon as possible.
